Welcome to Bahama Seoul. These Terms and Conditions ("Terms") govern your access to and use of the Bahama Seoul website, services, content, and any related communications (collectively, the "Site"). By accessing or using this Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About Bahama Seoul

Bahama Seoul is a boutique music production studio and creative house providing songwriting, music production, instrumental creation, lyric refinement, brand music, and sync licensing services.

2. Eligibility

By using this Site, you confirm that you are at least 18 years old or the legal age of majority in your jurisdiction and that you have the legal capacity to enter into binding agreements.

3. Services & Pricing

All services offered by Bahama Seoul are subject to availability. Prices displayed on the Site or in rate sheets are listed in BSD (Bahamian Dollars) unless otherwise stated and are subject to change at any time without prior notice.

All projects require a written agreement or email confirmation outlining scope, pricing, deliverables, and licensing terms before work begins.

4. Payments

A 50% non-refundable deposit is required before work begins unless otherwise agreed in writing.
The remaining balance is due upon delivery of final files or before first public use, whichever occurs first.
Payments are accepted via bank transfer unless otherwise specified.
Late payments may result in delayed delivery or suspension of services.

Bahama Seoul reserves the right to withhold deliverables until full payment is received.

5. Intellectual Property

All music, lyrics, instrumentals, audio files, text, graphics, logos, and content on this Site are the intellectual property of Bahama Seoul unless otherwise stated.

Clients receive licenses for use, not ownership, unless explicitly stated in a signed written agreement. Bahama Seoul retains all copyrights to compositions, recordings, and materials created.

You may not copy, reproduce, distribute, or exploit any Site content without prior written permission.

6. Licensing & Usage

Licensing terms (exclusive or non-exclusive), permitted uses, territory, and duration are defined per project and outlined in individual service agreements or invoices.

Unauthorized use of Bahama Seoul’s music or materials beyond the granted license constitutes copyright infringement.

7. Revisions & Creative Direction

Reasonable revisions are included only as outlined in the specific service agreement. Excessive revisions, scope changes, or new creative directions may incur additional fees.

Creative decisions are made collaboratively, but Bahama Seoul retains final creative discretion unless otherwise agreed.

8. Turnaround Times

Estimated turnaround times are provided in good faith but are not guaranteed. Delays caused by client feedback, approvals, payment issues, or unforeseen circumstances are not the responsibility of Bahama Seoul.

9. Cancellations & Refunds

Deposits are non-refundable once work has commenced.
If a project is canceled by the client after work begins, the deposit will be retained.
Completed work delivered in accordance with the agreed scope is not eligible for refunds.

10. Third-Party Platforms

This Site may link to third-party websites or platforms (e.g., streaming services, social media). Bahama Seoul is not responsible for the content, policies, or practices of third parties.

11. Disclaimer

All services and content are provided "as is" and "as available." Bahama Seoul makes no guarantees regarding commercial success, chart performance, placements, or audience reception.

12. Limitation of Liability

To the fullest extent permitted by law, Bahama Seoul shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of this Site or services.

Total liability, if any, shall not exceed the amount paid by the client for the specific service giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless Bahama Seoul from any claims, damages, losses, or expenses arising out of your misuse of the Site, breach of these Terms, or violation of any third-party rights.

14. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of The Commonwealth of The Bahamas, without regard to conflict of law principles.

15. Changes to Terms

Bahama Seoul reserves the right to update or modify these Terms at any time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
